Terms of Service

These Terms of Service govern your use of the 405 Growth Partners LLC website and any services you purchase from us. By purchasing services or approving a written project scope, you agree to these terms and any additional terms in that scope.

Services and project scope

We provide lead-generation strategy, offer positioning, lead-capture planning, pipeline setup, follow-up materials, and related consulting or implementation services. The exact deliverables, timing, responsibilities, and price for a project are stated in the applicable written scope, proposal, invoice, or checkout description.

Client responsibilities

You agree to provide accurate information, timely feedback, required access, lawful content, and approvals reasonably needed to perform the work. Delays in receiving these items may extend the delivery schedule. You are responsible for your business decisions, sales practices, legal compliance, customer communications, and use of delivered materials.

Fees and payment

Fees are due as stated at checkout or in the written scope. The $299 Local Lead Pipeline Pilot is a one-time service fee, not a recurring subscription. Advertising spend, third-party software, data, domains, and ongoing campaign management are separate unless expressly included in writing.

Results and no guarantees

Marketing and sales results depend on many factors outside our control, including market demand, competition, budget, offer quality, responsiveness, and sales execution. We do not guarantee a specific number of leads, appointments, customers, revenue, or return on investment.

Intellectual property

After full payment, you may use final client-specific deliverables created for your project. 405 Growth Partners retains ownership of its pre-existing materials, processes, frameworks, know-how, templates, and reusable tools. Third-party assets remain subject to their applicable licenses.

Confidentiality

Each party agrees to use reasonable care to protect non-public business information received from the other and to use it only for the project, except where disclosure is required by law or the information is already public through no breach of these terms.

Third-party services

Projects may involve independent third-party services such as payment processors, email platforms, advertising networks, website hosts, or software tools. Their availability, terms, prices, security, and performance are outside our control and are governed by their own agreements.

Cancellations and refunds

Cancellations and refunds are governed by our Cancellation & Refund Policy, which is incorporated into these terms.

Limitation of liability

To the fullest extent permitted by law, 405 Growth Partners will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising from the website or services. Our total liability relating to a paid project will not exceed the fees you paid us for the project giving rise to the claim. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.

Acceptable use

You may not misuse the website or services, interfere with their operation, attempt unauthorized access, submit unlawful or infringing material, or use deliverables for deceptive, discriminatory, abusive, or illegal activity.

Governing law

These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Before filing a claim, the parties agree to make a good-faith effort to resolve the issue directly.

Changes and contact

We may update these terms for future use of the website or services. Material changes do not retroactively change an agreed project scope unless both parties agree. Questions may be sent to 405growthpartners@gmail.com.
